Competition Law

Services offered include:

The Competition Commission investigates complaints relating to anti-competitive behaviour in South Africa and refers matters to the Competition Tribunal for compliance resolution
Notifiable mergers are submitted to the Competition Commissioner and referred to the Competition Tribunal for adjudication
Restraints of trade are enforceable unless the person being restrained can show that the restraint is contrary to public policy
Use of trade secrets may be regulated in contracts and is enforceable
Unauthorised use of trade secrets is not condoned by the Courts

Achievements
Our firm has successively represented an interested party company, where its supplier was the subject of a complaint, and has advised on the filing of a counter complaint.

We have practical experience of the requirements for a complaint and the response to a complaint particularly that the economic outcome be investigated at the outset.

The firm has advised on the requirements of merger notification.
